1. Acceptance of these terms

These Terms of Service ("Terms") govern your access to and use of the Eat Saves website and membership services (the "Services"), operated by Eat Saves, 7446 State St, Ste 371, Phoenix, AZ 85004. By creating an account, submitting the sign-up form, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. Membership eligibility

You must be at least 18 years old and able to form a binding contract to become a member. You agree to provide accurate, current and complete information when you sign up and to keep that information up to date. You are responsible for activity that occurs under your account.

3. Deals, offers and pricing

Eat Saves is a deals and savings platform. We publish and distribute discounts and promotions offered by third-party merchants. Eat Saves does not sell products or services and does not process purchases or payments for merchant offers.

• Offers are subject to availability and may change, expire or be withdrawn at any time.
• Prices, original prices and discount percentages shown are provided for illustration and depend on merchant participation.
• Each merchant sets its own redemption rules, blackout dates and limits. Your transaction with a merchant is solely between you and that merchant.
• Offers have no cash value and may not be resold, transferred or combined unless stated.

4. SMS messaging program terms

If you check the applicable consent box and provide your mobile number, you may receive text messages from Eat Saves. The following terms apply to our SMS program:

• Program description. Eat Saves sends recurring automated service updates and account notifications, and — where separately consented to — marketing and promotional messages, to the phone number you provide.
• Message frequency. Message frequency varies based on your account activity and the deals matched to your interests.
• Message and data rates. Message and data rates may apply. Charges are billed by and payable to your mobile service provider.
• Opt-out. You can cancel at any time by replying STOP to any message. After you reply STOP we will send one confirmation message and then stop sending messages to that number.
• Help. For more information, reply HELP to any message, email info@eatsaves.com, or call (602) 338-3639.
• Consent is not a condition of purchase. Consent to receive text messages is not required to purchase any products or services, and is not required to use the Eat Saves membership.
• Carriers. Supported carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier.
• Your number. Your mobile number will not be shared with third parties or affiliates for their own marketing purposes.

5. Acceptable use

You agree not to misuse the Services, including by attempting to gain unauthorized access, scraping or redistributing member-only offers, submitting false information, interfering with the operation of the Services, or using the Services in violation of any applicable law.

6. Intellectual property

The Eat Saves name, logo, site content and compilation of offers are owned by Eat Saves or its licensors and are protected by intellectual property laws. You may use them only as needed to use the Services as intended.

7. Third-party merchants and disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. Eat Saves does not warrant that any offer will be available, honored, or suitable for your needs, and is not responsible for the goods, services, acts or omissions of participating merchants.

8. Limitation of liability

To the maximum extent permitted by law, Eat Saves and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of savings, profits, data or goodwill arising out of your use of the Services.

9. Termination

You may stop using the Services and request account deletion at any time. We may suspend or terminate your membership if you violate these Terms or if we discontinue the Services.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after an update constitutes acceptance of the revised Terms.
